Global Product Liability

Overview

Product liability exposure can be an unwieldy animal, with unforeseen risks: manufacturers and developers are increasingly marketing their products in unconventional ways, operations are becoming more complex, and the outcome of using social media can be unpredictable, all potentially resulting in explosive litigation. Given the uncertainties regarding the risks, DLA Piper is here to help.

DLA Piper is proud to feature a premier and innovative product liability litigation practice; dedicated to address your legal needs whenever and wherever they arise. Comprised of almost 150 lawyers in 15 offices throughout the United States, as well as lawyers in many other offices around the world, our US product liability lawyers have in-depth experience representing clients in five core areas:

Pharmaceuticals
and medical devices

DLA Piper is a leader in pharmaceutical and medical device litigation. Among the accolades we have received: in 2015, Chambers & Partners recognized DLA Piper as a finalist for Product Liability Practice Group of the year, and The Legal 500 recognized us as a top-tier firm in the field from 2014 – 2017. We represent many of the leading manufacturers of pharmaceutical and biological medications and medical devices in product liability and related litigation. We have experience in mitigating the risk of product liability litigation from beginning to end, including:

Assessing potential areas of risk before litigation commences and counseling clients on practical ways to mitigate that risk.

Serving as national counsel in defending against a number of highly publicized nationwide product liability litigations.

Experience in the role of scientific evidence in evaluating the risk of claims before they arise and defending against product liability cases once litigation is filed, with successful Daubert motions.

Preparing for and winning cases at trial, including developing core defense themes and trial strategy from the early stages of litigation.

Resolving litigation in a swift and cost-effective manner.

Regulatory

We offer full-service support on product liability compliance and defense through our team of dispute resolution and regulatory lawyers, many of them ex-regulators, who are well equipped to negotiate and work with local regulators and law enforcement agencies to get the best outcome for our clients. Our attorneys have deep experience advising on the requirements of national and regional regulatory authorities, including the implementation of directives in local markets and ensuring compliance in multi-market and multi-product operations. We formulate compliance solutions that can satisfy the most demanding requirements and cover the widest range of risks, while still promoting consistency across all business activities and geographic regions.

In the US, we help keep clients up-to-date and compliant with ever-changing product safety laws, regulations, and policies, including from the US Consumer Product Safety Commission (CPSC), Food and Drug Administration (FDA) and numerous states and localities. We liaise with the CPSC and state regulators on our clients' behalf. We have extensive experience in regulatory, warning, labeling, and product literature best practices and requirements in electronics, children's products, industrial products, cosmetics, automotive products, e-cigarettes and much more. Our clients comprise all roles in the supply chain, including leading manufacturers, importers, distributors and retailers. Our litigators have particular experience with the rules and regulations relating to FDA (including N LEA, DSHEA, FDCA), FTC, USDA and EPA. We also have experience advising and defending our clients in investigations and/or actions brought by organizations such as FDA, CSPI, NAD, FTC and Attorneys General.

When our lawyers guide clients through government or private enforcement actions, we focus on achieving client goals efficiently, whether that means vigorous litigation or efficient resolution. We focus on minimizing impacts to our clients' operations.
