Global Product Liability

Overview

In Morocco, producers, importers and service providers are required to ensure the safety of their products and their products’ compliance with any specific local regulation.

The legislative framework governing product liability was introduced in Morocco following the entry into force of law No. 24-09 relating to the security of products and services. This law introduced a statutory liability of the manufacturer for damages caused by a product defect.

The procedure for filing claims is governed by the Obligations and Contracts Code and by the Civil Procedure Code. Law No. 31-08 enacting consumer protection measures also provides the possibility for the National Federation of Consumer Protection Associations as well as consumer protection associations recognized of public utility to institute or intervene in legal proceedings for the defense of consumer interests and exercise all rights accorded to a civil party in relation to actions that are prejudicial to the collective interest of consumers.
